Driver cited, facing criminal charges, after fatal TN accident

Everyone must play by the same rules. And yet, that frequently does not happen, as certain Knoxville residents violate the rules, which can result in severe injury to others.

A simple failure to yield, for example, can result in a car accident that seriously injures other motorists who had the right of way. In other cases, a motorist's decision to speed or engage in distracted driving can cause devastating accidents hurting others.

This was unfortunately the case in a recent crash that occurred when a pickup truck crossed the center line and struck a second pickup truck in a head-on crash. The collision killed the driver of the second pickup, while the driver and a 10-year-old passenger riding in the first vehicle were also injured. After the crash, the driver of the first vehicle was cited for failing to maintain a lane and driving on a revoked license, while criminal charges remain pending.

In tragic cases like the above, those injured should understand what legal rights they have to hold the other driver accountable. In a personal injury lawsuit, legal liability can be found based on the negligent driver's violation of the rules of the road.

Traffic laws can play a major part in these actions, if the other motorist was cited for speeding, failing to yield or any other violation, it can be used as evidence to prove that motorist was at fault for the crash. This is important, because negligence must be proven before any damages will be awarded to the injured party, which means the injured person will need to establish that the other driver was at fault for causing the crash.
